Introduction

Welcome to Lexora AI! These Terms and Conditions ("Terms") govern your use of the Lexora AI mobile application (the "App") provided by Lexora AI By accessing or using our App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our App. Please read these Terms carefully to understand your rights and responsibilities.

Acceptance of Terms

By accessing or using the Lexora AI App, you acknowledge and agree to comply with these Terms and Conditions. If you disagree with any part of these Terms, we kindly request that you discontinue using our App.

Eligibility

You must be at least 16 years old to use our App, as per the Indian Contract Act, 1872. Minors under 18 may use the App only under the supervision of a parent or legal guardian who agrees to these Terms. By using the App, you represent and warrant that you meet these eligibility requirements and have the authority to enter into these Terms. Lexora AI is not liable for misuse by ineligible users, including minors without proper consent. Users must provide accurate information and obtain parental consent for minors, if applicable. We reserve the right to terminate accounts of users under 18 without proper consent or those providing inaccurate information.

Accounts

To access certain features, such as personalized English-speaking feedback or premium content, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities conducted under your account.
• Promptly notifying us at contact@lexoraai.in of any unauthorized access or security breaches.

Lexora AI is not liable for losses or damages resulting from your failure to protect your account credentials.

Subscription and Payment

Lexora AI offers freemium features and premium subscriptions for enhanced functionality. By subscribing, you agree to:

• A recurring monthly fee charged automatically to your linked payment method (e.g., UPI, credit/debit card, or net banking).
• Bear any additional charges, such as bank transaction or currency conversion fees, which are your sole responsibility.
• Maintain sufficient funds in your account to ensure uninterrupted access.

Refund and Cancellation Policy

• Trial & Monthly Subscriptions: Refunds are not available for trial periods, monthly subscriptions, or payments for prior months.
• Cancellation: You may cancel your subscription at any time via the App's Membership page or the applicable payment gateway. No fees will be charged for subsequent months after cancellation, and automatic payments will cease for the next billing cycle.
• Cancellation Process: Follow the instructions on the Membership page or contact contact@lexoraai.in for assistance.

We reserve the right to modify subscription prices or discontinue services at any time without notice. Lexora AI is not liable for any modification, price change, suspension, or discontinuance of the App.

License and Restrictions

Subject to your compliance with these Terms, Lexora AI grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the App on your personal device(s) for non-commercial purposes. You agree not to:

• Modify, copy, or create derivative works of the App.
• Reverse engineer, decompile, or disassemble the App.
• Remove any copyright, trademark, or proprietary notices.
• Resell, sublicense, or exploit the App commercially.
• Use the App for unlawful purposes or to interfere with its functionality.
• Use automated tools (e.g., bots, spiders) to monitor or copy App content.
• Overburden or impair our servers or networks.

User Responsibilities

You are responsible for:

• Ensuring the confidentiality of your account information.
• All activities under your account, including any unauthorized use not promptly reported.
• Complying with all applicable laws and regulations while using the App.
• Notifying us immediately at contact@lexoraai.in of any security concerns.

Failure to report unauthorized access may result in account termination.

User Conduct and Prohibited Activities

You are prohibited from using the App or its content to:

• Engage in unlawful activities or solicit others to do so.
• Violate international, federal, or state laws, rules, or regulations.
• Infringe upon Lexora AI's or others' intellectual property rights.
• Harass, abuse, defame, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, or disability.
• Submit false or misleading information.
• Upload viruses or malicious code that could harm the App or other systems.
• Collect or track others' personal information without consent.
• Engage in spamming, phishing, or other harmful activities.
• Use the App for obscene, immoral, or harmful purposes.
• Circumvent the App's security features.

We reserve the right to terminate your access for violating these prohibitions.

Intellectual Property

All content on the Lexora AI App, including text, graphics, audio, videos, and software, is the exclusive property of Lexora AI or its licensors and is protected by international copyright laws. Unauthorized reproduction, distribution, or misuse of this content is strictly prohibited and may result in legal action. Lexora AI reserves all rights not expressly granted in these Terms.

User Content

The App allows you to create, upload, or submit content, such as audio recordings or text ("User Content"). You retain ownership of your User Content but grant Lexora AI a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content for App-related purposes, including providing feedback, improving services, and marketing.

You represent and warrant that:

• You have all necessary rights to grant this license.
• Your User Content does not infringe third-party rights or violate applicable laws.

Lexora AI reserves the right to remove User Content that violates these Terms or our community guidelines, including content that is:

• Harmful, harassing, defamatory, obscene, or otherwise objectionable.
• Infringing on intellectual property or privacy rights.
• Misleading, unlawful, or promoting illegal activities.
• Containing viruses or malicious code.
• Threatening public order, national security, or international relations.

Accessibility

Lexora AI is committed to making the App accessible to all users, including those with disabilities. We adhere to Web Content Accessibility Guidelines (WCAG) standards, offering features like alternative text, keyboard navigation, adjustable fonts, and screen reader compatibility. We welcome feedback on accessibility issues at contact@lexoraai.in to continuously improve usability.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Lexora AI does not guarantee that the App will be uninterrupted, secure, error-free, or that results from its use will be accurate or reliable. You use the App at your own risk.

Limitation of Liability

To the fullest extent permitted by law, Lexora AI, its affiliates, officers, directors, employees, agents, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising from your use of or inability to use the App, even if advised of such damages. Lexora AI's total liability for any claims shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Lexora AI, its affiliates, officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, or costs (including reasonable attorneys' fees) arising from:

• Your use of the App.
• Your violation of these Terms.
• Your infringement of third-party rights through User Content or actions.

Termination

Lexora AI may suspend or terminate your account or access to the App at any time, without notice, for reasons including but not limited to:

• Violation of these Terms.
• Engaging in fraudulent, illegal, or harmful activities.
• Spreading hate speech or inappropriate content.

You may terminate your account at any time via the App's settings or by contacting contact@lexoraai.in. Upon termination, all licenses granted to you will cease, and you must delete all copies of the App from your device(s).

Privacy

Your privacy is a priority at Lexora AI. Please review our Privacy Policy for details on how we collect, use, and protect your personal information. Key points include:

• Data Protection: We implement robust security measures, including encryption and access controls, to protect your data, though we cannot guarantee absolute security against external breaches.
• Use of Information: Your data is used to personalize your experience, improve the App, and provide support.
• Sharing: We do not share your personal information with third parties except as outlined in our Privacy Policy or required by law.
• Your Rights: You may access, correct, or delete your data by contacting contact@lexoraai.in.

Dispute Resolution

Any disputes arising from these Terms or your use of the App will be resolved through arbitration in Wardha, India, under the Arbitration and Conciliation Act, 1996. You agree to submit to the exclusive jurisdiction of courts in Wardha for any legal proceedings not subject to arbitration.

Third-Party Links and Content

The App may include links to third-party websites, services, or content not controlled by Lexora AI. We are not responsible for the accuracy, content, or practices of these third parties. You access third-party links at your own risk and should review their terms and policies before engaging.

Governing Law

These Terms are governed by the laws of India, without regard to its conflict of law provisions. Any legal actions not subject to arbitration shall be resolved in the courts of Wardha, India.

Changes to These Terms

We may update these Terms periodically. Changes will be posted on this page with an updated "Effective Date." For existing users, changes take effect 30 days after posting unless otherwise stated. Your continued use of the App after changes constitutes acceptance of the updated Terms.

Force Majeure

Lexora AI is not liable for failure to perform obligations under these Terms due to unforeseen events beyond our control, such as natural disasters, governmental actions, or civil unrest ("Force Majeure Events"). We will notify users of such events and strive to resume services promptly.

Feedback and Complaints

We value your feedback and encourage you to share suggestions or concerns at contact@lexoraai.in. We aim to address complaints promptly to improve your experience.

Support (Chat/Email)

Lexora AI may suspend chat or email support services without notice. We are not responsible for delays in responding to queries. Communications may be stored for future reference. You agree not to use support channels for:

• Sharing objectionable or unlawful content.
• Selling products or soliciting others.

Mode of Payment

Payments for subscriptions or in-app purchases can be made via:

• Credit/debit cards.
• Net banking.
• UPI or other supported payment methods.

We recommend using instant payment methods for faster processing. All payments are subject to the terms of the applicable app store or payment gateway.

Waiver

Failure by Lexora AI to enforce any provision of these Terms does not constitute a waiver of that provision. Any waiver must be in writing and signed by Lexora AI.

Safety

Lexora AI is committed to providing a safe learning environment. Guardians must supervise minors during App usage to ensure safety. We encourage reporting any safety concerns to contact@lexoraai.in.
